Omak Granted Injunction Against Pot Shop

The City of Omak was granted an injuction Friday, to keep a marijuana retail shop from opening despite being refused a business license.

The City of Omak filed for an injunction against Montana Dutton and Sage Shop LLC because she does not have a business license to operate in the City of Omak. She was denied a business license in July 2014 based on Omak’s business license requirements that a business has to be in compliance with state, local and federal laws.

Sage Shop LLC does not currently have a Washington State Liquor Control Board license to operate a retail marijuana business. According to the Liquor Control Board, a final inspection is scheduled for May 6th.

According to City Attorney Mick Howe, this inspection forced the City of Omak to file for an injunction with the court because product sales were eminent.  

Okanogan County Superior Court Judge Henry Rawson found that the City of Omak had the right to enforce it’s ordinances and requirements therefore issued an injunction prohibiting Montana Dutton and Sage Shop LLC from opening, operating, or dispensing marijuana related products at 903 Engh Rd #C.
