Small Guilty on Three Counts

A jury has found 50-year-old Kelly Small guilty on three counts and delivered no verdict on one count, 12 days after the trial began. Small, who was charged with first-degree rape, first-degree attempted murder and first-degree burglary for a Feb. 26, 2006, assault of a 75-year-old Omak woman, was found guilty Thursday afternoon on the charges of Rape, Burglary and the crime of forgery. The jury could not come to a decision on the charge of attempted murder.

On February 26, 2006, a man broke into the woman's Omak residence by removing an air conditioning unit, and the woman was raped and strangled with a telephone cord until she passed out. She did not recognize her assailant, and the case went unsolved for four years.

Small is also charged in Okanogan County Superior Court with first-degree aggravated murder, first-degree rape and burglary for the March 6, 1998 homicide of Sandy Bauer. Bauer once owned the Cariboo Motor Inn in Okanogan, and was 51 when her mother found her strangled in the basement apartment of their Omak home.

Jury selection in that trial begins on September 10th.
